Search Targets*
Search Target means the type of data a search will return. For example, a Cases search target will return a list of cases.
Cases - The Cases search target conducts a search for Patent Cases. Patent Cases means federal civil actions and administrative proceedings matching the selected search filters. For the patents library, this includes (i) federal civil actions in U.S. district courts or the Court of Federal Claims addressing the infringement, validity or enforceability of a U.S. patent flagged with Nature of Suit ("NOS") 830 in the PACER system as well as other cases that are known to meet the above criteria, (ii) investigations by the U.S. International Trade Commission ("ITC") pursuant to 19 U.S.C. §1337 and 19 C.F.R. Parts 201 and 210 involving allegations of infringement of a U.S. patent as reported in the ITC’s Electronic Document Information System ("EDIS"), and (iii) applications to the U.S. Patent and Trademark Office Patent Trial and Appeal Board ("PTAB") under 35 U.S.C. § 6(b)(4) (including IPR, CBM and PGR review), as reported in the PTAB’s Patent Review Processing System ("PTAB E2E") (this does not include proceedings conducted pursuant to 35 U.S.C. § 6(b)(1)-(3) such as appeals of adverse decisions of examiners, appeals of reexaminations, or derivation proceedings).
Note on Case Relationships
The concept of a "case" is relatively well understood by those involved in litigation. But cases are often related to other cases in ways that blur the distinction between the two. For example, if a case is transferred to another court, how many cases exist? PACER contains two case files each with a different case numbers. But is it accurate to say the plaintiff filed two cases or that the patent was asserted in two cases? No; there is a single case that existed in two different courts at two different times. To further complicate the issue, some courts, upon receiving a transferred case, will copy all of the previous docket entries to the new case file, thereby creating duplicate docket entries. Services that simply scrape PACER data without accounting for these case relationships will double count both the number of cases and key events that occur in those cases. Docket Navigator solves this by associating documents with each case that forms a part of the proceedings. This association, entered by hand, allows us to accurately identify all cases in which an event occurred. It also allows us to correctly identify unique instances of particular events and disregard any duplicate recordings.
Documents - The Documents search target conducts a search for key litigation documents matching the selected search filters. Key litigation documents include: (i) pleadings and other initiating documents (complaints, counterclaims asserting new patents, petitions, etc.) and amendments thereto; (ii) decisions, orders, and judgments issued by the court or agency that that could potentially impact the rights of the parties or the merits of any claim or defense (orders addressing housekeeping matters typically are not included); and (iii) for administrative proceedings, certain filings by the parties. Except as described above, filings by a party such as motions, supporting briefs, supporting declarations and the like, are generally not included.
Docket Sheets - The Docket Sheets search target conducts a search for docket entries in Patent Cases, that is the individual entries (usually sequentially numbered and dated) in the official record of proceedings and filings of a civil action or administrative proceeding. For federal civil actions, this includes docket sheets reported by the Public Access to Court Electronic Records ("PACER"). For the International Trade Commission, this includes the record of documents filed in relation to an investigation as reported by the Electronic Document Information System ("EDIS"). For the Patent Trial and Appeal Board, this includes the record of documents and proceedings in an IPR, CBM, or PGR proceeding as reported by Patent Trial and Appeal Board End to End ("PTAB E2E").
Remedies - The Remedies search target conducts a search for remedies entered in Patent Cases. This includes monetary damages, preliminary and permanent injunctive relief, sanctions, and other monetary awards such as costs, attorney fees, enhanced or punitive damages, fines, and the like. Each judicial or administrative order to pay and each judicial or administrative directive to a party is counted as a separate monetary award. For example, if a court enters an injunction against three parties that would count as three injunctions. Remedies are reported as they occur, and may not reflect the final judgment or decision of the court or agency.
Patents - The Patents search target conducts a search for Litigated Patents. Litigated Patents means U.S. patents asserted or challenged in a Patent Case. It does not include patents referenced in a case (e.g., as prior art) but not asserted or challenged.
Accusations - The Accusations search target conducts a search for Patent Accusations. A Patent Accusation is a request for relief in a Patent Case, the resolution of which could determine if a patent has been infringed or the patent’s validity or enforceability. Docket Navigator records accusations as a group of data consisting of a patentee name, a patent challenger name (often an accused infringer), the patent being asserted or challenged, and the outcome of the accusation.
Parties - The Parties search target conducts a search for parties in Patent Cases. Party names are normalized by hand such that variations in spellings ("John Doe" and "John A. Doe") are treated as the same person or entity.
Attorneys - The Attorneys search target conducts a search for attorneys representing parties in Patent Cases. Attorney names are normalized by hand such that variations in spellings ("John Doe" and "John A. Doe") are treated as the same person.
Firms - The Firms search target conducts a search for law firms representing parties in Patent Cases. Firm names are normalized by hand such that variations in spellings ("Jones Day Reavis & Pogue" and "Jones Day") are treated as the same firm.
Participants - The Participants search target is like the Parties, Attorneys and Firms targets, but it conducts a search for a combined group of data consisting of (i) a Patent Case, (ii) a party involved in that Patent Case, (iii) the law firm representing that party, and (iv) an attorney at the law firm. It is useful for researchers whose primary goal is to export highly granular data for further analysis.
Terms - The Terms search target conducts a search for patent claim terms that have been the subject of claim construction in a Patent Case. Docket Navigator records claim terms and claim constructions that appear in any significant order. This includes orders following a claim construction or Markman hearing, but also encompasses orders on any other type of motion.
PTAB Institutions - The PTAB Institutions search target conducts a search for data related to the PTAB’s institution decision in an IPR, CBM or PGR proceeding. PTAB Institution data includes the challenged patent claims by number, the grounds for the challenge, and the outcome of the institution decision.
Determinations - The Determinations search target conducts a search for data related to Patent Determinations. A Patent Determination occurs when a court or administrative agency issues a decision that determines the infringement, validity (or patentability), or enforceability of one or more claims of a patent. There may be more than one determination per patent and determinations may be overturned or reversed in later proceedings. Determinations may be made in connection with a stipulation or agreement of the parties, but many searches allow for the exclusion of such determinations if desired. Determinations are recorded by patent number, not on individual claims.
Expert Witness*
We collect PTAB expert witness data from the PTAB using a novel, semi-automated process supplemented by human editors.
- We scrape exhibit lists from various documents, primarily petitions and responses, to identify declarations filed in the proceeding.
- We examine the text of each declaration to determine whether it is an expert declaration originally filed in this case. Attorneys, fact witnesses, and other types of non-expert declarations are filtered out using a combination of two techniques:
- A rules-based technique looks for hints in the text, such as “I have been retained by [party] as a technical expert”
- A machine learning technique broadly examines all features of the document, such as the declarant’s writing style and paragraph organization, to determine whether the given document is an expert declaration.
- A portion of the declarations are set aside for manual review by our team for various reasons, including rules conflicts and low prediction confidence scores.
- An automatic text labeling technique is used to detect the names of experts in these cases. All expert names are reviewed by the Docket Navigator team (for example, to verify that “Anne Smith” and “Annette B. Smith” are the same person).
Our internal tests found that about 97% of expert witnesses are accurately associated with PTAB proceedings using this method. Because the first digit of a PTAB filing’s docket number indicates the filer’s role, we expect expert-party associations to be highly accurate.
Search Filters*
A filter limits a search result to items matching the selected filter. For example, a Cases search target with a Courts filter will return a list of cases in the selected courts.
Note
Multiple filters may be selected simultaneously and many filters have unique relationships with other filters. For example, a Document Filter Group creates a filter group consisting of 4 filter categories: posture, document type, result, and legal issue.

Document Filter Group - Searches for documents with the selected DOCUMENT FILTER GROUP. A Document Filter Group ("DFG") is group of filters with a defined relationship that models the structure of court and agency decisions typically found in orders and judgments. A DFG consists of one or more POSTURE of MOTION, DOCUMENT TYPE, RESULT of MOTION and LEGAL ISSUE filter, exclusively related to one another. For example, the following 8 filters could be entered as a single DFG.

The Document Filter Group drawer supports multiple DFGs in a single search. So for example, you can search for documents granting a motion for summary judgment of patent noninfringement or denying a motion for summary judgment of infringement. While there are two posture of motion filters (granted and denied) they relate to different document types.

Where the document type is a motion, the search is for orders deciding the selected type of motions, not the motions themselves.
Document Text - Searches for documents matching the selected boolean or natural language TEXT query. Documents are included in the results if all the specified words, their synonyms, or related words are present in the document. The words are not required to match exactly and are not required to be in order. Some documents require optical character recognition (OCR) to allow this form of searching; these documents may contain OCR errors which affect the results of the search.
Document Types - Searches for documents of the selected DOCUMENT TYPES. Where the document type is a motion, the search is for orders deciding the selected type of motions, not the underlying motion papers.
Filing Party - Searches for documents filed by the selected PARTIES. Selecting "begins with" requires the party name to begin with the specified word or phrase. Posture of Motion - Searches for documents with the selected POSTURE of MOTION. "Posture" indicates the procedural status or process in effect when presenting a motion or request to the court or agency. In essence, posture indicates how a motion is "teed up" to the court. The most common posture is "motion by a party" which indicates a contested motion presented in the usual course of proceedings. Other examples include, sua sponte (the court’s own motion), ex parte (emergency motion), motion to reconsider, remand, and stipulated/agreed.
Result of Motion - Searches for documents with the selected RESULT of MOTION. "Result" indicates the outcome of a motion or request for relief. Example results include granted, denied, granted in part, and the like.
